Attorney Positions

Recruiting at Grimshaw & Harring starts locally. While we have a long standing Summer Clerk program, we do not hire a new class of attorneys each year. Rather, we hire new associates only after assessing our long term needs. We take pride in the fact that we have grown thoughtfully over the last fifteen years, hiring when necessary to achieve a long term growth plan, rather than simply to grow larger. Our low attrition rate is evidence that each attorney is hired with the intent that the fit will be long term. Please direct all inquiries to Russ W. Dykstra.

Our mission is to achieve success for our clients. To help us make this happen, we understand it is imperative to have an exemplary support staff. For our 24 attorneys, we employ five paralegals, seven legal assistants, and an administrative staff of six more. Most of our staff members have been with us for years, with more than half crossing the ten year mark. Water Law

Our water law clients include water and metropolitan districts, water and wastewater authorities (comprised of numerous water districts and metropolitan districts), real estate developers, ranchers, irrigators, reservoir companies, irrigation companies and golf course developers. Our water lawyers have practiced in this specialty area of the law since 1970, securing dozens of complex decrees for the water supply plans for numerous metropolitan districts throughout Colorado, for municipalities such as the Town of Vail and the City of Grand Junction, for Colorado’s largest irrigation company, for numerous real estate developers, for new and established ski resorts and golf courses, and for individual property owners. In addition, we have evaluated water rights, assisted clients in the purchase or sale of water rights, helped to obtain well permits and we have been involved in countless cases and appeals to protect our clients’ water rights.

Our water lawyers have secured decrees for complicated augmentation plans for the Denver Technological Center and other Southeast Denver Metropolitan area special districts. They represented the Douglas County Water Resource Authority in implementing a conjunctive use project that enjoys unprecedented West Slope/East Slope/Denver Water Board/State Engineer cooperation, to augment the water supplies of water districts and metropolitan districts in Douglas County. They also represent the Arapahoe County Water and Wastewater Authority, which presently provides water and wastewater services to a significant part of the population of Arapahoe County.

Real Estate Finance

We represent developers and property owners in a broad range of real estate financing transactions, including acquisition, construction, bridge, and permanent loans, as well as private placements, syndications, and other equity transactions. We have handled financing transactions in most segments of the real estate industry, including single-family developments, raw land, multi-family developments, resorts, industrial sites, residential condominiums, office buildings, hotels, casinos, community developments, and shopping centers, and regional and local malls.

We are also counsel to a number of commercial banks, thrifts, insurance companies and other lending institutions. Our real estate lawyers serve many out-of-state lenders on a local-counsel basis, addressing their real estate loans in Colorado and providing documentation and opinion letters as to compliance with Colorado law. In addition to structuring and closing real estate loans, our attorneys handle workouts and restructuring of problem loans and foreclosures when loans are in default.

Community and Homeowner Associations

Bachelor Gulch, Eagle County In representing community associations, we are experienced in handling real property, contract, transition, employment, insurance, corporate (including meetings and elections), collection, and litigation issues. We often interpret Colorado law, including the Colorado Common Interest Ownership Act (“CCIOA”) and the Colorado Non-Profit Corporation Act and federal laws as they affect covenant controlled communities. Our attorneys act as general counsel to a large number of condominium and townhome projects, single-family residential, subdivisions, mixed-use projects, and commercial business parks throughout Colorado.

Our community association attorneys are available to draft, review, and amend governing documents, address covenant enforcement issues and assessment collection (including foreclosures), provide general corporate advice, review insurance policies and available coverage, attend board meetings, and provide prompt responses to matters of utmost importance to our community association clients. We have advised our clients on various issues including transition from developer control, covenant enforcement litigation, employment disputes, contested elections, conducting annual and special meetings, disputes with vendors, and bankruptcy related matters. We also assist special district clients who are charged with design review and covenant enforcement powers. We can also represent individuals who own property in common interest communities.

We coordinate our efforts with professional property managers and also work directly with self-managed properties. We maintain a membership in the national chapter of the Community Association Institute, as well as the Rocky Mountain Chapter. Municipal and Governmental Law

Our attorneys have served as general counsel to scores of Colorado’s special districts and municipalities, including cities, fire protection districts, water and sanitation districts, metropolitan districts, business improvement districts, intergovernmental authorities, and others for over 45 years. They provide services regarding the formation and ongoing representation of these entities in the areas of municipal law, election law, TABOR issues, finance, water law, environmental law, litigation, and other related areas. In addition, our firm serves as bond counsel to numerous political subdivisions throughout the state.

As counsel to special districts, our firm has been involved in developments ranging from approximately 5 acres to developments in excess of 25,000 acres. Insurance Litigation

Representing policyholders with insurance questions has long been a focus of our litigation attorneys and an area in which they have considerable expertise. Many of our numerous precedent-setting cases have established the rights of individuals, local governments, and businesses (ranging from multi-national conglomerates to small “mom” and “pop” gasoline-dispensing convenience stores) to recover from their insurance companies. Our attorneys have experience in a broad range of insurance coverage issues, from clients facing damages from a single occurrence, like the collapse of a wastewater treatment plant’s 80 foot high filtering tower or a spontaneous bodily injury, to claims spanning multiple coverage periods, such as progressive construction defects and deterioration, extensive groundwater contamination or asbestos exposure, and earth movement or structural failure. Equally critical is the law of “insurance bad faith,” and the representation of those policyholders whose insurance carriers have failed to abide by the coverage terms of their policies.Three of Colorado’s key appellate decisions acknowledged the duty of insurance companies to defend policyholders for environmental damage claims under business policies and declared their rights of recovery. These precedent-setting decisions have had a major impact on the availability of insurance coverage for all policyholders, not only in Colorado, but around the country.

Our insurance coverage attorneys are regularly called upon to advise other counsel seeking the firm’s particular insurance coverage expertise, including in-house corporate attorneys and general counsel, insurance defense lawyers, legislators considering new laws, city and county attorneys, environmental attorneys, and general practitioners representing businesses and individuals. We are regularly called upon to represent out-of-state clients because of our unique experience, and we serve as counsel for a wide variety of public entities and private companies, including agricultural products companies, aircraft manufacturers, cities and counties, commercial landlords, construction companies, dry cleaners, environmental consulting firms, lenders, mining companies, real estate developers, ski area owners, wastewater treatment plants, and water and sanitation districts.

Appeals

Because trial court litigation routinely results one or more appellate issues, our litigation attorneys recognize the importance of applying appellate experience early in the lawsuit to both the procedural and substantive issues, to optimize the client’s position and create efficient and effective strategies at the trial court level. We provide ongoing consultation during trial, assistance with substantive motions, post-trial motions, interlocutory appeals and extraordinary writs. We also assist with the appellate strategy, including evaluation of the record, the possible appellate forums, the legal issues, preparation and review of briefs, and oral arguments. Our appellate attorneys represent clients before the Colorado Court of Appeals, the Colorado Supreme Court, the United States Court of Appeals for the Tenth Circuit Court, and the United States Supreme Court. Several of our attorneys have served as law clerks for appellate court judges, which brings a unique and useful perspective to the appellate process.
