Our attorneys have served as general counsel to scores of Colorado’s special districts and municipalities, including cities, fire protection districts, water and sanitation districts, districts, , intergovernmental authorities, and others for over 45 years. They provide services regarding the formation and ongoing representation of these entities in the areas of municipal law, election law, TABOR issues, , water law, environmental law, litigation, and other related areas. In addition, our firm serves as bond counsel to numerous political subdivisions throughout the state.

Our have tried or settled dozens of cases involving Denver Airport (DIA), E-470 Public Highway Authority’s toll road around Denver, the Colorado Department of Transportation’s project to expand Interstate 25 (T-REX), and various FasTracks projects.  We have represented private landowners in various urban renewal projects.  We have advanced many of Colorado’s significant public improvement projects, dating back to the acquisition of rights of way for Colorado’s major interstate highways.  We have also acquired property for open space, recreation, drainage improvement projects, water pipelines, city halls, roadways, schools and even a county jail.

Our eminent domain practice also includes appellate work: we have appeared in eminent domain cases in the Colorado Court of Appeals and the Colorado Supreme Court over thirty times.  Our are also frequent lecturers at continuing legal education seminars as well as conferences and seminars relating to land use, planning, trial techniques and appraisal methodology.

Ms. Mayers practices in the areas of (with an emphasis on community associations), coverage disputes, employment law, civil and commercial and collections.  In her practice, she acts as general counsel to a large number of condominium, townhome, single family, resort and mixed-use developments, and she provides counsel to special districts that have been assigned design review and covenant enforcement powers.  As part of her practice, Lisa represents policyholders in disputes with their carriers and personal injury plaintiffs.  She litigates cases before state and federal courts in Colorado, as well as the Colorado Court of Appeals.

  •  Recovery of Non-Economic Damages in Delayed Diagnosis of Cancer Cases, William J. Brady and Lisa K. Mayers, 27 Colo. Law. 95 (Nov. 1998). Physicians in Colorado may be liable for emotional distress damages if they fall below the legal standard of care in failing to aggressively pursue and definitively diagnose symptoms of cancer or other life-threatening diseases in a timely and responsible manner. So long as an increased risk of harm develops from the unchecked growth of cancer [even though the risk is unlikely to materialize], medical malpractice plaintiffs in Colorado have a cause of action for emotional distress resulting from a delayed diagnosis. This article examines the recent opinion of the Colorado Supreme Court in Boryla v. Pash and its likely impact on physicians and patients in Colorado.1 The authors represented the plaintiff both at trial and through both levels of appeal.

Mr. Kron holds a Bachelor of Urban Planning and a B.A. LAS (Political Science) from the University of Illinois-Urbana, an M.S. in Urban and Regional Planning from the University of Wisconsin-Madison, and he earned his J.D. from the University of Colorado in Boulder. Before and during law school, he worked for several years in community energy research at Argonne National Laboratory in Argonne, Illinois.

Mr. Dykstra represents governmental and private sector clients in the areas of project finance, public/private infrastructure projects, , transportation, and development. His practice includes project financing, construction contracting, design build contracts, governmental contracting, operational aspects of special districts and infrastructure operations, elections, statutory compliance, budgeting and finance matters, including compliance. Mr. Dykstra has participated in a large number of financing projects and the formation of many special districts in Colorado. Mr. Dykstra has acted as lead local counsel on the only large transportation public private partnership to date in Colorado and has extensive experience negotiating and drafting concession leases, financing and appurtenant documents pertaining to infrastructure projects in the state involving international corporations and financiers. THOMAS T. GRIMSHAW received his B.A. from the University of Minnesota in 1953 with a Journalism major and a minor in Political Science. He received his law degree from Northwestern University in 1956 and has practiced in Denver, since that time. Mr. Grimshaw’s legal expertise lies in the areas of local government with an emphasis on infrastructure development, funding and construction, as well as in the area of land development with an emphasis on , planning and zoning.

A former member of the State Board for Community Colleges and Occupational Education, served two terms in the Colorado General Assembly as a State Representative, and during that time sponsored the Colorado Housing Act. He has served extensively as a consultant to local governments on infrastructure development and to land developers and homebuilders on land use, planning and zoning issues. He was one of only a few leaders who shared their collective visions over 25 years ago in an effort to tackle Denver’s transportation needs, and he helped guide the newly completed and well-executed T-REX project. Mr. Grimshaw remains involved to this day.

Heavily involved in the community, Mr. Grimshaw has chaired the Denver Partnership, the Colorado Housing Authority, Business for Better Government, the Colorado Council on Economic Education, Brothers Redevelopment Inc., Exempla Inc., Swallow Hill Music Association and the Colorado Community College System Foundation.  He has served on the board of Sturm Financial Corp. and is a life member of the Uniform Law Conference.  In 2008 he was named one of Colorado’s top Individuals in Zoning and Land Use, by the UK based Chambers & Partners.

District Organization

One of the special services that our firm provides to developers, citizen groups, leaders, and governmental entities is assistance in the organization of a variety of that will shoulder the burden of financing, and subsequently constructing and maintaining, necessary infrastructure for property being developed or underserved. The infrastructure may include water service, sewer service, fire protection, roads, curbs, gutters, storm drains, sidewalks, parking facilities, public restrooms, governmental buildings, park and recreational facilities, boundary walls, and other public facilities and improvements. We have been involved in developments ranging from a few acres to those in excess of 25,000 acres. We have organized literally hundreds of special improvement districts of every major type allowed under law. The organization of these districts provides a valuable and cost-effective method of financing the construction of improvements that are essential to a complete and integrated development.

We are very familiar and experienced in all of the statutory requirements for district formation, beginning with the preparation and submission of service plans, negotiation with local government staff and officials, obtaining approval at public hearings, obtaining court approval, and assisting with all aspects of the initial election, including questions for the voters in a proposed district to decide whether to organize the district, who the first directors will be, the amount of bonds that may be sold, the allowable property tax rate, and the allowable spending limit.

In unincorporated areas of the State, special districts are an essential tool for developers to assure that, after the development is complete, there will be a stable and well financed entity that will carry on the operation and maintenance of the infrastructure that was put in place to serve the community. Usually, we continue to represent the district after the development is complete to help it function as originally intended.

In developed or new commercial areas, can help and operate public improvements and services benefiting the entire business community. In addition to organizing BIDs, we also advise them after organization on matters from rebuilding Main Street, to joint marketing, to holiday decorations, to park improvements, and more.
